1. No Medical Services : Bettami does not provide medical services, treatments, or advice. We are not a healthcare provider, hospital, or medical facility. All medical services are provided solely by the independent healthcare providers accessible through our platform.
2. Information Accuracy : While we strive to ensure the accuracy of information on our platform, we cannot guarantee that all information is complete, accurate, or up-to-date. Users should verify any information with healthcare providers directly.
3. No Endorsement : The presence of a healthcare provider on our platform does not constitute an endorsement or recommendation by Bettami. Users are responsible for making their own evaluations of healthcare providers.
4. Medical Decisions : All medical decisions, including but not limited to diagnosis, treatment plans, and surgery decisions, should be made solely between the patient and their chosen healthcare provider. Bettami bears no responsibility for these decisions or their outcomes.
Indemnification:
By using the Bettami platform, you agree to indemnify, defend, and hold harmless Bettami, its officers, directors, employees, agents, licensors, and suppliers from and against all losses, expenses, damages, and costs, including reasonable attorneys' fees, resulting from:
1. Your violation of these terms and conditions or any law or regulation.
2. Your violation of any rights of another person or entity.
3. Any claim related to your use of the services provided through our platform, including but not limited to claims arising from medical consultations, second opinions, or surgical procedures facilitated through Bettami.
4. Any content you submit, post, transmit, or make available through our platform.
This indemnification obligation will survive the termination or expiration of your use of the Bettami platform.
Limitation of Liability:
To the fullest extent permitted by applicable law, Bettami shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:
1. Your use or inability to use the platform.
2. Any conduct or content of any third party on the platform, including without limitation, any defamatory, offensive, or illegal conduct of other users or third parties.
3. Any content obtained from the platform.
4. Unauthorized access, use, or alteration of your transmissions or content.
In no event shall Bettami's total liability to you for all damages, losses, or causes of action exceed the amount you have paid to Bettami in the last six (6) months, or, if greater, one hundred dollars ($100).
Governing Law and Jurisdiction:
This legal notice and any disputes arising out of or related to the use of the Bettami platform shall be governed by and construed in accordance with the laws of Delaware, without regard to its conflict of law provisions.
You agree that any legal action or proceeding between you and Bettami shall be brought exclusively in the courts located in Delaware. By using the Bettami platform, you hereby consent to the personal jurisdiction of such courts.
